Terms and Conditions

These Terms and Conditions constitute a legally binding agreement made between the user, whether personally or on behalf of an entity (“User”), and Focuzen (“We,” “Us,” or “Our”), concerning access to and use of the Focuzen mobile application, including but not limited to all services, features, systems, content, technologies, and tools made available therein (the “Application”).

By downloading, accessing, registering for, or using the Application in any manner, the User expressly acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions without limitation or exception. Such acceptance is given knowingly and voluntarily and shall have the same legal force and effect as a written agreement.

If the User does not agree to all or any portion of these Terms, the User is expressly prohibited from accessing or using the Application and must immediately discontinue all use thereof.

Any additional terms, supplemental policies, usage guidelines, or other rules displayed within the Application from time to time shall form an integral part of and have the same legal force as these Terms and Conditions.

We reserve the right, at Our sole discretion, to amend, modify, update, or revise these Terms at any time for operational needs, feature development, legal changes, or other considerations. Any changes will be indicated by updating the “Last Updated” date. Continued use of the Application after such modifications constitutes full acceptance of the revised Terms.

The Application is operated from Bandung, Indonesia, and is not intended for use in any jurisdiction or territory where such use would violate applicable laws or regulations.

The Application is available to users of various age ranges. By using the Application, the User represents and warrants that they have the legal capacity to enter into this agreement in accordance with applicable law.

If the User has not reached the age of majority or does not possess full legal capacity under applicable laws, the User represents that they have obtained the consent, permission, or supervision of a parent or lawful guardian as required by law.

Unless otherwise expressly stated, all intellectual property rights in the Application, including but not limited to source code, databases, system architecture, visual design, user interface, features, text, images, illustrations, logos, icons, trademarks, and software (“Content”), are owned by Focuzen or lawfully licensed to Focuzen and are protected by copyright and applicable laws.

The Content provided in the Application is for personal and non-commercial use only. The User is prohibited from copying, reproducing, modifying, distributing, selling, leasing, transferring, or otherwise exploiting any Content without prior written consent from Us.

We grant the User a limited, non-exclusive, non-transferable, and revocable license to access and use the Application solely for its intended productivity purposes.

The User represents and warrants that all information provided to Focuzen is true, accurate, complete, and kept up to date.

The User represents that they have the legal authority to agree to these Terms and assume full responsibility for all activities conducted through the Application. The User agrees not to use the Application for any unlawful purpose, in violation of public order, or in infringement of any third-party rights.

The User further agrees not to access the Application through automated means, bots, scripts, or other non-human methods. All use must comply with applicable laws and regulations. We reserve the right to suspend or terminate the User’s account for any violation of these Terms.

To access certain features, the User may be required to create an account via email, Google, or Apple. The User is solely responsible for maintaining the confidentiality of account credentials, including passwords and login information.

All activities occurring under the User’s account are the sole responsibility of the User. We reserve the right to suspend, restrict, or delete any account found to be in violation of these Terms.

The User is prohibited from using the Application for any unlawful or unauthorized purpose. The User shall not reverse engineer, decompile, disassemble, or otherwise attempt to extract or replicate the structure of the Application.

The User shall not upload malicious files, viruses, malware, or any content that may harm the system or other parties. Identity misrepresentation, impersonation, unauthorized commercial exploitation, interference with Application security or performance, and use of automated tools for mass data extraction are strictly prohibited.

Violations may result in immediate suspension or termination without prior notice.

The Application allows Users to upload, store, and manage content such as text, photos, files, tasks, and projects (“User Content”). Ownership of User Content remains with the User.

Focuzen does not use User Content for promotional or commercial purposes. Such content is processed solely as necessary to support the technical and operational functions of the Application. The User is fully responsible for ensuring that their User Content does not violate any law or third-party rights.

By uploading User Content, the User grants Focuzen a limited, non-exclusive, and non-transferable license to store, process, and display such User Content solely for the purpose of operating the Application.

This license does not grant Focuzen any right to commercialize, promote, or distribute User Content outside the Application’s functional scope.

Focuzen offers several access models, including a free version with limited features, a 3-day Free Trial for premium features, monthly subscription plans, and a one-time lifetime purchase, subject to availability within the application.

After the Free Trial period ends, access to premium features will automatically be discontinued unless the user upgrades to a paid subscription plan. For monthly subscription plans, charges will automatically renew for the selected billing period unless the user cancels the subscription before the renewal date through their respective platform account settings.

All payments are processed through the official payment systems of Google Play Store for Android users and Apple App Store for iOS users, and subscription status is managed and validated via RevenueCat. Focuzen does not directly store users’ credit card information or payment details.

All payments made are final and non-refundable, except where required by applicable law or in accordance with the official refund policies of the respective app distribution platforms.

Focuzen reserves the right to modify pricing, subscription structures, feature availability, or access models at any time in response to business or technological developments. Any pricing changes will not affect active subscription periods until the end of their current billing cycle.

The Focuzen application integrates artificial intelligence (AI) features powered by Google Gemini 2.0 Flash to provide services such as AI Coaching, productivity analysis, activity summaries, and interactive chatbot responses.

These AI features are designed to assist users in improving focus, time management, and productive habits. However, all outputs, analyses, suggestions, recommendations, and responses generated by the AI system are automated and provided for informational purposes only, based on the data available at the time of processing.

To support technical functionality, enhance user experience, and analyze performance and usage patterns, Focuzen uses cookies and similar technologies. By using the Application, the User acknowledges and agrees to the use of cookies as described herein.

Cookies are small data files stored on the User’s device that recognize devices, store preferences, maintain login status, and ensure session stability. Focuzen may also use local storage, pixels, and web beacons for analytics and service improvement.

Cookies used include essential cookies necessary for core functionality, functional cookies to store preferences, analytical cookies to understand anonymized usage patterns, performance cookies to identify technical issues, and limited marketing cookies used solely for internal promotion without cross-site tracking by third parties.

Cookies help secure accounts and login sessions, prevent unauthorized access, store user preferences, analyze productivity patterns, and deliver relevant updates.

For performance analysis and service development, Focuzen may use third-party analytics services such as Google Analytics, Firebase, or similar providers. Data processed is aggregated and anonymized and not used to personally identify Users beyond operational needs.

Users may control cookie usage through Application or device settings. However, disabling certain cookies may impact functionality, including automatic login and data synchronization.

Cookie data is retained only as long as necessary and protected with reasonable technical safeguards.

Focuzen utilizes third-party services to support authentication, subscription management, and AI-powered features. These services include, but are not limited to: Clerk (user authentication and account management), Google Sign-In (login via Google account), Apple Sign-In (login via Apple account), RevenueCat (subscription and in-app purchase management), and Google Gemini 2.0 Flash (AI chatbot functionality).

Where a user chooses to log in via Google or Apple, the information received by Focuzen is limited to the data authorized by the user in accordance with the respective platform’s policies (such as name and email address).

For subscription purchases, transactions are processed through the official payment systems of the applicable platform (Apple App Store or Google Play Store) and managed via RevenueCat. Focuzen does not directly collect or store users’ credit card information.

All third-party services are subject to the respective providers’ terms, privacy policies, and licensing conditions. Such services are used solely to support the functionality of the application and to enhance the user experience.

Focuzen may use visual assets, icons, or design elements from third parties, including open-source assets. One such asset includes emojis from Twemoji, a project owned by Twitter, Inc., licensed under the MIT License.

The MIT License permits use, modification, and distribution in accordance with its terms. Ownership of third-party assets remains with their respective copyright holders, and Focuzen does not claim ownership thereof.

We reserve the right to suspend or terminate User access to the Application at any time in the event of violation of these Terms or applicable law. Upon termination, all rights to use the Application shall automatically cease.

We may modify, suspend, or discontinue all or part of the Application at any time. We do not guarantee uninterrupted or error-free availability.

These Terms are governed by the laws of the Republic of Indonesia. Any dispute shall be resolved through arbitration in accordance with applicable regulations in Indonesia. Class actions are not permitted.

The Application is provided on an “as is” and “as available” basis. We disclaim all warranties to the fullest extent permitted by law.

To the fullest extent permitted by law, Focuzen shall not be liable for indirect, incidental, or consequential damages arising from use of the Application.
